Welcome to BookMyStay. These Terms and Conditions govern your use of our website, mobile services, booking platform, and any related services offered through BookMyStay. By accessing or using our website, creating an account, making a booking, or making a payment, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms, please do not use the website or book any service through BookMyStay.

Definitions
In these Terms and Conditions, “BookMyStay,” “we,” “our,” and “us” refer to the owners, operators, and authorized representatives of BookMyStay. “User,” “you,” and “your” refer to any visitor, customer, guest, or person using the website or services.

“Property” means any hotel, resort, villa, homestay, apartment, or accommodation listed on the platform. “Booking” means any reservation made through the website, whether paid in full, partially paid, or reserved with a token amount.

Use of website
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the website.

You must not misuse the website, attempt unauthorized access, upload malicious code, use false information, or make fraudulent bookings. We reserve the right to suspend or terminate access if we believe a user has violated these Terms.

Eligibility
By using this website, you confirm that you are legally capable of entering into a binding contract under applicable law. If you are making a booking on behalf of another person, you confirm that you are authorized to accept these Terms on their behalf.

Booking terms
All bookings made through BookMyStay are subject to availability, confirmation by the property or service provider, and successful payment where applicable. A booking is not considered confirmed until you receive a confirmation message, email, invoice, or booking voucher from us.

We try to ensure that all information on the website, including room availability, pricing, amenities, photos, policies, and descriptions, is accurate. However, errors may occasionally occur, and we reserve the right to correct any pricing, content, or availability errors at any time before confirmation of the booking.

Pricing and charges
Prices displayed on the website may be shown per night, per stay, per room, per guest, or per package, depending on the listing. Applicable taxes, convenience fees, service charges, cleaning charges, security deposit, or other extra charges may be added at checkout or may be payable directly to the property, depending on the booking terms.

Users are advised to carefully review the price breakup before making payment. BookMyStay is not responsible for assumptions made by the user regarding inclusions that are not clearly mentioned in the booking details.

Payment terms
To complete certain bookings, you may be required to pay full payment, partial payment, advance payment, token amount, or security deposit. Payment obligations will be clearly shown during checkout or communicated before confirmation.

BookMyStay reserves the right to cancel or hold any booking if the required payment is not completed within the specified time.

Razorpay payment policy
BookMyStay may use Razorpay and/or other authorized third-party payment processors to collect payments on the website. By making a payment through our platform, you agree to be bound by the terms and policies of Razorpay and the relevant banking/payment networks in addition to these Terms.

When you make a payment, your card, UPI, net banking, wallet, or other payment details are processed through Razorpay’s secure payment infrastructure. BookMyStay does not store your complete card or banking details on its own servers unless explicitly stated and lawfully required.

Payments are subject to successful authorization by your bank, card network, UPI provider, wallet provider, and Razorpay. If a transaction fails but the amount is debited from your account, the reversal or refund timeline will depend on Razorpay, your bank, and the payment source used.

In case of payment success but booking non-confirmation due to unavailability, pricing error, technical issue, or vendor rejection, the paid amount or applicable refundable amount will be processed back to the original source according to our cancellation/refund policy.

BookMyStay shall not be liable for any payment failure, delay, bank outage, UPI downtime, authentication issue, chargeback restriction, or transaction decline caused by Razorpay, banks, card issuers, payment gateways, telecom operators, or any third-party payment infrastructure.

Users must use only their own valid payment instruments or payment methods they are legally authorized to use. Fraudulent transactions, unauthorized use of cards/accounts, suspicious activity, payment abuse, or chargeback misuse may result in booking cancellation, account suspension, legal reporting, and recovery action.

If any chargeback, payment dispute, reversal, or unauthorized transaction claim is raised after a booking has been confirmed or consumed, BookMyStay reserves the right to provide relevant booking and transaction details to Razorpay, banks, and law enforcement authorities, and to recover losses, dues, penalties, and administrative charges from the user where legally permitted.

Refund and cancellation
Cancellation and refund rules may vary from property to property, package to package, and offer to offer. The cancellation policy shown at the time of booking shall apply to that specific reservation.

Some bookings may be non-refundable, partially refundable, or subject to cancellation charges. In eligible refund cases, the refund will usually be initiated to the original payment source within a reasonable processing period, but actual credit time may vary depending on Razorpay, the payment method, and the user’s bank.

Convenience fees, gateway charges, taxes, or non-refundable components may be deducted where applicable and permitted. If a refund is blocked due to incorrect bank details, closed account, expired card, or payment processor limitations, the user must cooperate to complete alternate lawful refund formalities.

Modification and rescheduling
Changes to booking dates, guest count, room type, property, or other details are subject to availability and the applicable policy of the property or service provider. Additional charges may apply for any modification or rescheduling request.

BookMyStay does not guarantee that all change requests can be accommodated after booking confirmation.

Check-in and guest responsibility
Guests must carry valid government-issued identification at the time of check-in, as required by the property and applicable law. Local residents, unmarried couples, foreign nationals, child policies, pet policies, and group stay policies may differ by property.

Users are responsible for reviewing the property rules before booking. Any denial of check-in due to failure to meet property rules, provide valid ID, follow occupancy rules, or comply with local regulations may be treated as a no-show or cancellation as per the applicable booking policy.

User information
You agree that all details provided by you, including name, phone number, email, address, guest details, and payment-related details, are true, accurate, and complete.

If we find that any user information is false, misleading, outdated, or suspicious, we may suspend the booking, ask for verification, or refuse service.

Third-party properties and services
BookMyStay may act as an intermediary, aggregator, listing platform, marketing platform, or booking facilitator for hotels, villas, homestays, tour packages, transport providers, or other travel-related services.

While we make reasonable efforts to list reliable properties and correct information, the actual stay experience, services, cleanliness, facilities, staff behavior, food quality, local conditions, and safety standards are primarily the responsibility of the respective property or service provider.

No-show and failed arrival
If you fail to check in on time, do not arrive, cannot be contacted, or do not meet the property’s check-in requirements, the booking may be treated as a no-show. In such cases, refunds, if any, will depend on the applicable booking and cancellation policy.

Promotions and discounts
Promo codes, coupons, referral credits, seasonal offers, or special discounts may be subject to separate terms. BookMyStay reserves the right to modify, suspend, withdraw, or cancel any promotional offer at its discretion in case of misuse, technical error, duplication, or fraud.

Intellectual property
All content on this website, including text, graphics, logos, layout, branding, icons, images, code, and design elements, belongs to BookMyStay or its licensors unless otherwise stated. Unauthorized copying, reproduction, resale, scraping, republication, or commercial use is prohibited without prior written permission.

Limitation of liability
To the maximum extent permitted by law, BookMyStay shall not be liable for any indirect, incidental, special, punitive, or consequential loss, including loss of money, business, reputation, travel disruption, missed plans, inconvenience, or personal dissatisfaction arising from use of the website or any booking made through it.

Our total liability, if any, in relation to a booking shall generally not exceed the amount actually paid by you to BookMyStay for the relevant booking, except where a greater liability is required under applicable law.

Force majeure
BookMyStay shall not be responsible for failure or delay in performance caused by events beyond reasonable control, including natural disasters, floods, landslides, pandemic restrictions, strikes, civil unrest, government orders, transport shutdowns, technical outages, cyber incidents, or acts of God.

Indemnity
You agree to indemnify and hold harmless BookMyStay, its owners, employees, affiliates, agents, and partners from any claims, losses, damages, costs, penalties, or legal expenses arising out of your misuse of the website, breach of these Terms, fraudulent transaction, payment dispute, or violation of any law or third-party rights.

Privacy
Your use of the website is also subject to our Privacy Policy. By using the website or making a booking, you consent to the collection, use, storage, and sharing of your information as described in the Privacy Policy and as reasonably required to process bookings and payments.

Termination
We reserve the right to suspend, restrict, or terminate any user account, booking request, listing access, or website usage at our discretion in case of breach of these Terms, suspicious activity, fraud risk, payment disputes, or legal compliance requirements.

Governing law and jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or relating to the use of the website, bookings, or payments shall be subject to the exclusive jurisdiction of the competent courts at [Your City/State].
